It is recommended that an order be entered authorizing the General Superintendent or her designee to enter into a contract with KLF Enterprises, Inc. for the Supply and Delivery of Sand, Gravel, Stone and Related Materials. No work may commence and no payment shall be made prior to the execution of a written agreement.
II. Award Information

Contract Period: Two (2) year initial term with three (3) additional one (1) year extension options. If the extension options are exercised, funding shall be based upon annual appropriations.
Contract Amount: Not-to-exceed $400,000.00 for the initial contract term.
Expenditures for services under each extension term will be authorized by annual appropriation and subject to each year’s budget. DUR Contract
Affirmative Action
Goals: The Minority-and Women Owned Business Enterprise participation for this contract include: 25% MBE and 5% WBE.
Scope of Services: The Awardee shall provide all equipment, fuel, labor, materials, transportation, trucks, vehicles and any/all other services necessary to supply and delivery sand, gravel, stone and related materials to locations throughout the CPD.
Authorization: Authorize the General Counsel to include other relevant terms and conditions in the written Agreement. Authorize the General Superintendent to execute the Agreement and the Secretary to attest as to the signing of the Agreement and keep an original copy of the Agreement on file.

Bid Evaluation Detail: Lowest Responsive and Responsible Bidder
This contract was publicly advertised as an Invitation for Bids (“IFB”), and there were two (2) bids received on the due date and time listed above, and were tabulated. The Department of Purchasing (“Purchasing”) determined that two of the two (2) bids were responsive and responsible. The Department of Cultural and Natural Resources reviewed the bid of the apparent lowest responsive and responsible bidder that best meet the department needs. Accordingly, the lowest responsive and responsible bidder is: K.L.F. Enterprises, Inc.
V. Explanation
The Chicago Park District (CPD) maintains nearly 9000 acres of parkland and approximately 75 miles of walking, running and bike paths. Used year-round, these CPD facilities provide a significant recreational resource for the public. The successful management and maintenance of these resources are critical components of the CPD’s stated mission as a provider of safe, inviting and well-maintained recreational opportunities. The walking, running and bike paths, as well as other landscape features, require ongoing upkeep and repair by the Department of Cultural and Natural Resources. Therefore, it is in the best interest of the Chicago Park District to award KLF Enterprises, Inc., the contract for the Supply and Delivery of Sand, Gravel, Stone and Related Materials.
VI. General Conditions
1) Conflicts: The Agreement shall not be legally binding on the Chicago Park District if entered into in violation of the provisions of 50 ILCS 105, the Public Officer Prohibited Activities Act.
2) Ethics: The Chicago Park District’s Ethics Code, Chapter III of the Code of the Chicago Park District, shall be incorporated into and made part of the agreement.
3) Contingent Liability: Any agreement lawfully entered into for a period of more than one year shall be executory only for the amounts for which the Park District may become liable in succeeding fiscal years pursuant to 70 ILCS 1505/17(i).
4) Economic Disclosure Statement (“EDS”). Contractor has submitted full and complete EDS.
