I. Recommendation
It is recommended that the General Superintendent and CEO or his designee enter into a contract with Site Design Group for design and construction phase services for improvements to the east end of the Midway Plaisance. The contractor was selected pursuant to a publicly advertised Request for Proposals (“RFP”) through a target market search. No work may commence and no payment shall be made to vendor prior to the execution of a written agreement.

Scope of Services: The scope of work of this project addresses one of the mitigation measures identified in the draft a Memorandum of Agreement (MOA) between the Federal Highway Administration, the Illinois State Historic Preservation Officer, and the Advisory Council on Historic Preservation was executed in December 2021: Replacement of recreational use area within Jackson Park that was restored in the 1980s using Urban Park and Recreation Recovery (UPARR) grant money. Because the footprint of the OPC development will modify the original UPARR boundary within Jackson Park, the City is required to dedicate replacement recreation property elsewhere. As part of a UPARR Amendment executed in May 2021 between the National Park Service and the City of Chicago (Grantee) and the Chicago Park District (Subgrantee), the recreation replacement will be partially addressed through the dedication of recreation area at the east end of the Midway Plaisance. To replace lost recreational opportunities and respond to community requests, the recreation replacement site will accommodate a combination of play area, open space, and rehabilitated walkways.

Action Goals: The Minority and Women-Owned Participation for this contract include: 65% Minority-Owned; specifically, Site Design Group Ltd. 52.7%; Advance Consulting Group, Intl 3.7%; GSG Consultants, Inc., 2.7%; and, Vistara Construction Services, Inc., 5.9%; and 35% Women-Owned. Site Design Group, Ltd. is a City of Chicago certified MBE and on this contract WBE participation will be provided by TERRA Engineering 27.3%; Heritage Architecture Studio 5.9%; and, MAP Strategies, LLC 1.8%.
Authorization: Authorize the General Counsel to include other relevant terms and conditions in the written Agreement. Authorize the General Superintendent to execute the Agreement and the Secretary to attest as to the signing of the Agreement and keep an original copy of the Agreement on file.

This contract was publicly advertised as a Target Market Request for Proposals (“RFP”). The Proposer was selected pursuant to a target market search.During the advertisement period the Department of Purchasing (“Purchasing”) received a request to extend the proposal due date. This request was granted and on August 18, 2021 the proposal due date was extended (5) calendar days from August 27, 2021 to September 1, 2021.
Four proposals were received on the due date and all proposals were found by the Department of Purchasing (“Purchasing”) to be compliant and responsive.
The Evaluation Committee (“EC”) was comprised of seven (7) voting members, six (60 CPD staff and one (1) non-CPD staff. There was also one (1) non-voting member, non-CPD staff. The EC began their evaluation of the proposals at their first meeting on September 17, 2021. They met again on September 21, 2021 and September 28, 2021 and decided at the conclusion of their meeting to invite all proposers to oral presentations. Oral presentations were held on September 28, 2021 and September 29, 2021, and each session lasted approximately 1 hour. The EC met once following oral presentations on September 29, 2021. The EC concluded their evaluation by scoring Site Design Group the highest.
V. Explanation

VI. General Conditions
1) Conflicts: The Agreement shall not be legally binding on the Chicago Park District if entered into in violation of the provisions of 50 ILCS 105, the Public Officer Prohibited Activities Act.
2) Ethics: The Chicago Park District’s Ethics Code, Chapter III of the Code of the Chicago Park District, shall be incorporated into and made part of the agreement.
3) Contingent Liability: Any agreement lawfully entered into for a period of more than one year shall be executory only for the amounts for which the Park District may become liable in succeeding fiscal years pursuant to Section 17(i) of the Chicago Park District Act, 70 ILCS 1505/17(i). All agreements authorized herein shall contain a clause that any expenditure beyond the current fiscal year is subject to appropriation in the subsequent fiscal year budget.
