I. Recommendation

It is recommended that the General Superintendent and CEO or his designee enter into an intergovernmental agreement with the City of Chicago for the purpose of constructing emergency shoreline protection measures at Arthur Ashe Beach. The Park District will partially fund the Project in a total amount of $500,000 (the "Park District Funds") with respect to Arthur Ashe Beach.

III. Explanation
Continued high lake levels throughout 2020 with high winds and large waves damaged Arthur Ashe Beach, undermining the revetment edge, sidewalk and roadway at East 74th Street. The Park District desires to have the City to make certain emergency repairs and improvements to Arthur Ashe beach located in the City's South Shore neighborhood. The City will partially fund the Project in a total amount of $500,000 on behalf of the Park District with respect to Arthur Ashe Beach. The Park District will partially fund the Project in a total amount of $500,000 (the "Park District Funds") with respect to Arthur Ashe Beach. The City will use the Park District Funds exclusively to acquire necessary materials, to compensate its contractors, and pay all capital costs related to the Project.

IV. General Conditions

1) Conflicts: The Agreement shall not be legally binding on the Chicago Park District if entered into in violation of the provisions of 50 ILCS 105, the Public Officer Prohibited Activities Act.
2) Ethics: The Chicago Park District's Ethics Code, Chapter III of the Code of the Chicago Park District, shall be incorporated into and made part of the agreement.
