AUTHORIZATION TO ENTER INTO A CONTRACT WITH COMCAST CORPORATION FOR TELECOMUNICATIONS SERVICES

I. Recommendation
Pursuant to Chapter XI, Section D, 1, b, (2), (a) of the Code of the Chicago Park District, it is recommended that the General Superintendent and CEO or his designee enter into a contract with Comcast Corporation to provide telecommunications services to park sites owned by the Chicago Park District.

Action Goals: Pursuant to Chapter XI, Section F, 2, a, of the Code of the Chicago Park District, Minority and Women Owned Participation requirements are not included.
Authorization: Authorize the General Counsel to include other relevant terms and conditions in the written Agreement. Authorize the General Superintendent to execute the Agreement and the Secretary to attest as to the signing of the Agreement and keep an original copy of the Agreement on file.

IV. Procurement Information
Pursuant to Chapter XI, Section D, 1, b, (2), (a) of the Code of the Chicago Park District, competitive sealed bidding is not required in cases involving the purchase of “…telecommunications service or other public utility”
V. Explanation
The Department of Information Technology network is currently connected to 250 site locations citywide. The network provides connectivity to the internet, email, shared files, our program registration system, and other enterprise applications of the Chicago Park District.
Today, there is a growing demand for high speed internet and an increased broadband subscription allowance for additional business needs, such as video surveillance for security, building automation for facility management, digital boards for marketing, Voice over IP (VoIP) upgrade from analog to digital telephony, and the expansion of private and free public internet connections in our fieldhouses and remote offices. Challenges facing this demand include aging carrier infrastructure and over-subscription of existing circuits.
Today, there are approximately 70 sites with internet connection provided to the Chicago Park District by Comcast with speeds ranging from 25Mbps to 75Mbps. As part of this proposed agreement, 21 sites will be added to Comcast and 36 sites will be upgraded to satisfy the demand of higher speed internet (100 Mbps to 1Gbps), place our network on newer and updated fiber optic infrastructure at select sites, upgrade services to fiber over coax speed at remaining sites, and overall run on a more stable internet connection.

It is the second-largest broadcasting and cable television company in the world by revenue and the largest pay-tv company, the largest cable TV company, and largest home internet service provider in the United States.
V. General Conditions
1) Conflicts: The Agreement shall not be legally binding on the Chicago Park District if entered into in violation of the provisions of 50 ILCS 105, the Public Officer Prohibited Activities Act.
2) Ethics: The Chicago Park District’s Ethics Code, Chapter III of the Code of the Chicago Park District, shall be incorporated into and made part of the agreement.
3) Contingent Liability: Any agreement lawfully entered into for a period of more than one year shall be executory only for the amounts for which the Park District may become liable in succeeding fiscal years pursuant to 70 ILCS 1505/17(i). The agreement shall contain a clause that any expenditure beyond the current fiscal year is subject to appropriation in the subsequent fiscal year budget.
