I. Recommendation

 

It is recommended that the General Superintendent and CEO or his designee enter into a contract with Industrial & Environmental Services, LLC (“IES”) for DuSable Park Phase I Thorium Screening and Remediation services.  The contractor was selected pursuant to a publicly advertised Invitation for Bids (“IFB”).  No work may commence and no payment shall be made to contractor prior to the execution of a written agreement.

Scope of Services:                     Includes excavation and remediation as needed to identify and dispose of thorium contaminated fill soils within the interior of the DuSable Park site.  This remediation project includes clearing and grubbing the site, systematically excavating the site in 18 inch lifts to allow for thorium screening of the fill material down to native sand, disposal of all thorium contaminated material, grading and vegetating the site with a native grass mix upon completion.

This contract was publicly advertised as an Invitation for Bids (“IFB”), and six (6) bids were received, opened, and read aloud on the bid due date and time.  The Department of Purchasing (“Purchasing”) reviewed all bids received and found them to be responsive and compliant.  Purchasing sent the bid package from the apparent lowest bidder to the Department of Planning and Construction for their review, and they found this bidder to be responsible.  Accordingly, Industrial & Environmental Services, LLC is the lowest responsive and responsible bidder for Thorium Screening and Remediation Phase I services at DuSable Park. 

 

V.  Explanation

 

DuSable Park is located in an area of reclaimed land that was built during the expansion of the Chicago Harbor development along Chicago’s lakefront.  The site is bounded by water (seawalls) on three sides; by the Ogden Slip to the north and east, the Chicago River to the south and Lake Shore Drive to the west.  The USEPA identified the Site in 2000 as having thorium contaminated material generated from milling and processing operations of the Lindsay Light and Chemical Company.  Over the years several thorium investigations and hotspot removals have been completed, but the site has never been fully screened for thorium contamination down to native sand. 

 

Ultimately the environmental liability for the thorium contamination at DuSable Park was found to be the responsibility of the Anadarko Petroleum Corporation (“Anadarko”).  The US Department of Justice and the USEPA entered into a settlement agreement with Anadarko for their environmental liabilities. Within the settlement, $6,800,000 was awarded to the DuSable Park site for remediation.  The Chicago Park District developed a thorium screening and remediation work plan that that was approved by the USEPA and incorporated into a Cooperative Agreement (#V-00EO2094-0) between the USEPA and the Chicago Park District.  

 

This project is for Phase I of the required thorium screening and remediation at DuSable Park.  Due to the age of the existing seawall, a new seawall will be needed in order to screen the fill material around the perimeter of the site and immediately adjacent to the seawall.  This seawall replacement and site exterior screening and remediation will be part of Phase II.  Phase II includes the screening and remediation of all material within a 40 foot setback of the existing seawall.

 

Industrial & Engineering Services has provided environmental remediation services throughout the Chicago metropolitan area and the Midwest for over 18 years.  Additionally, IES has performed numerous environmental projects including emergency spill response and remediation, various types of industrial maintenance, and removal of underground storage tanks for its federal, state and local agencies and private-sector clients.  Some of the clients for IES include the U.S. Army Corp of Engineers; Naval Facilities Engineering Command; National Park Service; and various municipalities in the states of Illinois and Indiana.

Therefore, it is in the best interest of the Chicago Park District to award Industrial & Environmental Services the contract for Thorium Screening and Remediation Services Phase I at DuSable Park.

 

VI. General Conditions

 

1) Conflicts: The Agreement shall not be legally binding on the Chicago Park District if entered into in violation of the provisions of 50 ILCS 105, the Public Officer Prohibited Activities Act.

 

2) Ethics: The Chicago Park District’s Ethics Code, Chapter III of the Code of the Chicago Park District, shall be incorporated into and made part of the agreement.

 

3)  Contingent Liability:  Any agreement lawfully entered into for a period of more than one year shall be executory only for the amounts for which the Park District may become liable in succeeding fiscal years pursuant to Section 17(i) of the Chicago Park District Act, 70 ILCS 1505/17(i).  All agreements authorized herein shall contain a clause that any expenditure beyond the current fiscal year is subject to appropriation in the subsequent fiscal year budget.

 

4)  Economic Disclosure Statement (“EDS”):  The contractor has submitted a full and complete EDS.
