II. Change Order #02 (Cont.)
This change order represents the purchase of construction engineering services as required by the Illinois Department of Transportation (IDOT). The initial design services contract was undertaken by the Chicago Park District with AECOM. The original scope of services was limited to only project design and engineering up to the development of 100% construction documents ready for IDOT bidding.

IDOT, thru the Federal Highway Administration High Priority Program, issued the construction project for bid based on an estimate and has since awarded a contract to Rausch Infrastructure LLC. With construction now underway, additional AECOM technical services are required including performance of Construction Management, Inspection and Engineering of Record Services as defined by IDOT.
This change order includes MBE participation by BD Sterling for resident engineering services at 19.3%and Material Services Testing, Inc at 9.0% (combined MBE of 28.3%). WBE participation by EDI at 5.6%.

These changes are germane to the original design agreement as signed and are in the best interest of the Chicago Park District. The consultant's proposal has been reviewed by the Project Manager and found to be reasonable.

IV. Explanation
The Grant Park - Queen's Landing lakefront structure and promenade is east of Lake Shore Drive and serves as a portion Chicago's popular lakefront. The project area runs from just south of the Chicago Yacht Club to the curve just north of the Shedd Aquarium. The area is approximately 4,250 feet of lakefront and approximately 158,000 square feet. This section of the lakefront connects major tourist destinations including downtown, the museum campus and the Buckingham fountain. Welcoming up to 5,400 visitors on any given weekday, the area can become congested. The project area is a vital transportation connection for local commuters, leisurely residents, and tourists and is in need of respite. The concrete along the project area is deteriorating creating uneven, unsafe, and unpleasant conditions for the thousands of daily users. Improvement to the project area would ensure continued use of the path and provide a safe and enjoyable lakefront trail experience for pedestrians.



V. General Conditions
1. Conflicts: No agreement authorized herein shall be legally binding on the Chicago Park District if entered into in violation of the provisions of the Public Officer Prohibited Activities Act, 50 1LCS 105/0.01 et seq.
2. Ethics: The Chicago Park District's Ethics Code, Chapter III of the Code of the Chicago Park District, shall be incorporated into and made part of all agreements authorized herein.
3. Contingent Liability: Any agreement lawfully entered into for a period of more than one year shall be executory only for the amounts for which the Park District may become liable in succeeding fiscal years pursuant to Section 17(i) of the Chicago Park District Act, 70 ILCS 1505/17(i). All agreements authorized herein shall contain a clause that any expenditure beyond the current fiscal year is subject to appropriation in the subsequent fiscal year budget.
4. Economic Disclosure Statement ("EDS'): Contractor has submitted a full and complete EDS prior to execution of the contract.
