I. Recommendation

 

It is recommended that an order be entered authorizing the General Superintendent or his designee to enter into a contract with Lakeshore Recycling Systems, LLC for Debris Dumping Transfer Station Services.  This contractor was selected pursuant to a publicly advertised Invitation for Bid.  No work may commence and no payment shall be made prior to the execution of a written agreement.

Contract Period:                     One (1) year initial term with four (4), one (1) year extension options. 

 

Contract Amount:                     $375,400.00 for the initial contract term.  Expenditures for services under each extension term will be authorized by annual appropriation and subject to each year’s budget.

                      

 

Scope of Services:                      To provide a transfer station to the CPD where CPD garbage trucks can dump debris collected primarily along the lake front. 

 

Affirmative Action                     The Minority and Women Owned Business Enterprise participation for this contract includes: 25% Minority Owned and 5% Women Owned.

                     

Authorization:                      Authorize the General Counsel to include other relevant terms and conditions in the written Agreement. Authorize the General Superintendent to execute the Agreement and the Secretary to attest as to the signing of the Agreement and keep an original copy of the Agreement on file.

This contract was publicly advertised as an Invitation for Bids (“IFB”).  Four (4) bids were received on the due date and time, and were publicly opened and read aloud. The Department of Purchasing (“Purchasing”) reviewed all bids and found them to responsive and compliant.  The IFB explicitly stated that the debris dumping transfer station must be capable of receiving and processing debris dumped by the CPD including food waste.  The Illinois Environmental Protection Agency (“IEPA”) permit for the apparent lowest bidder does not indicate food waste can be dumped at their transfer station.  Consequently, Purchasing determined them to be a non-responsible bidder and removed

 

their bid from consideration for award.  Purchasing then reviewed the bid from the next lowest and found that their IEPA permit did allow for food waste to be dumped at their transfer station.  Further, their bid did indicate that their transfer station met all the other requirements identified in the IFB, including being in Cook County and open 24/7/365.  The Department of Cultural and Natural Resources then reviewed their bid and it has been determined that Lakeshore Recycling Systems, LLC is the lowest responsible and responsive bidder.

 

V. Explanation

 

The Chicago Park District (“CPD”) collects debris primarily along the lakefront and in some parks.  The quantities of debris may vary depending on the season, but it can range from 60 tons to 900 tons, with the peak occurring April - October when the CPD may dump over 100 times daily.  Once collected, the CPD requires the services of a transfer station where it will dump the debris, including:  asphalt, cardboard, dirt, food waste, glass, paper, and plastic.

 

Lakeshore Recycling Systems operates a transfer station that has the capacity to receive and properly process the debris dumped by the CPD.  Their transfer station is located within Cook County and open 24/7/365. 

 

Lakeshore Recycling Systems has experience in operating debris dumping transfer stations.  They have been in this business for 15 years and are the prior contractor for the Chicago Park District.  Additionally, their transfer station is located within Cook County, and it has the capacity and personnel necessary to properly process the debris dumped by the CPD.

 

Therefore, it is in the best interest of the Chicago Park District to award Lakeshore Recycling Systems the contract for Debris Dumping Transfer Station Services. 

 

VI. General Conditions

 

1) Conflicts: The Agreement shall not be legally binding on the Chicago Park District if entered into in violation of the provisions of 50 ILCS 105, the Public Officer Prohibited Activities Act.

 

2) Ethics: The Chicago Park District’s Ethics Code, Chapter III of the Code of the Chicago Park District, shall be incorporated into and made part of the agreement.

 

3) Contingent Liability:  Any agreement lawfully entered into for a period of more than one year shall be executory only for the amounts for which the Park District may become liable in succeeding fiscal years pursuant to 70 ILCS 1505/17(i).

 

4) Economic Disclosure Statement (“EDS”). Contractor has submitted full and complete EDS.
