I. Recommendation

 

Pursuant to Chapter XI, Section C, 4 of the Code of the Chicago Park District, it is recommended that a change order be approved affecting the contract for the subject work; said change to authorize:

 

Change Order #02:  Services for the provision and installation of the Tennis Courts at Maggie Daley Park; addition of specialty signage to the project scope; and expanded fencing scope.

II. Award Information (Cont.)

 

Change Order #2: Services for the provision and installation of the Tennis Courts at Maggie Daley Park in the area known as “Peanut Park”. The work includes, but is not limited to, expanded stormwater detention, bituminous concrete pavement, exposed aggregate concrete pavement, tennis court surfacing and accessories, concrete pavement, fencing, site furnishings, sport court lighting and related electrical work, fine grading, import and planting soil placement, planting and sodding. 

 

Expanded fencing scope including work to furnish and install additional timber range fence at the east perimeter of the park and metal plant rail adjacent to the BP bridge, within the Play Garden Slide Crater area and near the Field House.

 

Work also includes the addition of specialty signage to the project scope. 

 

The MBE portion of this change order will be performed by Reyes Group for storm utility work and concrete in the amount of $434,656 (17.54%) and Legend Construction for painting in the amount of $34,475(1.39%).  The WBE portion of this change order will be performed by Autumn Construction Services for mechanical work in the amount of $38,689.00 (1.56%), Flood Testing for testing work in the amount of $53,072.00 (2.14%) and Jade Carpentry for carpentry work in the amount of $102,406.00 (4.13%).

 

Authorization:                     Authorize the General Counsel to include other relevant terms and conditions in the written Agreement.  Authorize the General Superintendent to execute the Agreement and the Secretary to attest as to the signing of the Agreement and keep an original copy of the Agreement on file.

IV. Explanation

 

Section X of the General Conditions of the contract permit changes to the scope of work.  Additionally, Chapter XI, Section #, 4, of the Code of the Chicago Park District permits change orders under one or more of the following circumstances:  (i) the circumstances that necessitate the change were not reasonably foreseeable at the time that the contract was signed; or (ii) the change is germane to the original contract as signed; or (iii) the change order is in the best interest of the project and the Chicago Park District as authorized by law.

 

Maggie Daley Park, opened in 2014, has transformed the former Daley Bicentennial Plaza and Peanut Park into a world-class, multi-functional park for Chicago.  This agreement will allow CPD to authorize the construction of six tennis courts in Peanut Park in accordance with the park master plan. This change order allows for the tennis courts to be completed and operational by Late Fall 2015.

 

This agreement also allows CPD to authorize the installation of additional fencing and additional specialty signage for the park.

 

This change is germane to the original contract as signed and is in the best interest of the project and the Chicago Park District

 

VI. General Conditions

 

1. Conflicts:  No agreement authorized herein shall be legally binding on the Chicago Park District if entered into in violation of the provisions of the Public Officer Prohibited Activities Act, 50 ILCS 105/0.01 et seq.

 

2. Ethics: The Chicago Park District’s Ethics Code, Chapter III of the Code of the Chicago Park District, shall be incorporated into and made part of all agreements authorized herein.

 

3. Contingent Liability:  Any agreement lawfully entered into for a period of more than one year shall be executory only for the amounts for which the Park District may become liable in succeeding fiscal years pursuant to Section 17(i) of the Chicago Park District Act, 70 ILCS 1505/17(i).  All agreements authorized herein shall contain a clause that any expenditure beyond the current fiscal year is subject to appropriation in the subsequent fiscal year budget.

 

4.  Economic Disclosure Statement (“EDS”): Contractor has submitted a full and complete EDS prior to execution of the contract.
