I. Recommendation
 
Pursuant to Chapter XI, Section C, 4 of the Code of the Chicago Park District, it is recommended that a change order be approved affecting the contract for the subject work.
 
Change Order #01:      Contractor to provide additional construction services for the expansion of the artificial turf baseball infield, installation of a playground, resurfacing of the existing asphalt walking path.            ADD $498,621.00

II. Award Information (Cont.)
 
Change Order #01:      
 
This change order includes converting the baseball infield to artificial turf rather than typical infield mix as originally bid. Scope also includes installation of a new playground as well as renovation of the existing pathway on the south side of the park. Work will require additional services for demolition, excavation, sewer, base preparation, installation of artificial turf, fencing, playground timbers and equipment, engineered wood fibar, grinding of existing asphalt and asphalt resurfacing.
 
The MBE portion of this change order will be performed by Martinez Frog Inc for material haul off and delivery in the amount of $37,000.00 (7.4%), Penn Services LLC. for concrete work and fencing work in the amount of $56,000.00 (11.2%) and Sanchez Paving for asphalt repair and repaving in the amount of $32,000.00 (6.4%). The WBE portion of this change order will be performed by JEM Development Inc. for site utilities in the amount of $43,000.00 (8.6%).
 
This change is germane to the original contract as signed and is in the best interest of the project and the Chicago Park District
 
The contractor's proposal has been reviewed by the Project Manager and found to be reasonable
 
Authorization:      Authorize the General Counsel to include other relevant terms and conditions in the written Agreement.  Authorize the General Superintendent to execute the Agreement and the Secretary to attest as to the signing of the Agreement and keep an original copy of the Agreement on file.

IV. Explanation
 
Section X of the General Conditions of the contract permit changes to the scope of work.  Additionally, Chapter XI, Section #, 4, of the Code of the Chicago Park District permits change orders under one or more of the following circumstances:  the change order is in the best interest of the project and the Chicago Park District as authorized by law.
 
 
VI. General Conditions
1. Conflicts:  No agreement authorized herein shall be legally binding on the Chicago Park District if entered into in violation of the provisions of the Public Officer Prohibited Activities Act, 50 ILCS 105/0.01 et seq.
 
2. Ethics: The Chicago Park District's Ethics Code, Chapter III of the Code of the Chicago Park District, shall be incorporated into and made part of all agreements authorized herein.
 
3. Contingent Liability:  Any agreement lawfully entered into for a period of more than one year shall be executory only for the amounts for which the Park District may become liable in succeeding fiscal years pursuant to Section 17(i) of the Chicago Park District Act, 70 ILCS 1505/17(i).  All agreements authorized herein shall contain a clause that any expenditure beyond the current fiscal year is subject to appropriation in the subsequent fiscal year budget.
 
4.  Economic Disclosure Statement ("EDS"): Contractor has submitted a full and complete EDS prior to execution of the contract.
