To The Honorable Board of Commissioners of the Chicago Park District:

 

I. Recommendation

 

Pursuant to Chapter XI, Section D, 7 of the Code of the Chicago Park District, it is recommended that an order be entered authorizing the General Superintendent and CEO or his designee to participate in the Insight Public Sector, Inc. contract with U.S. Communities Government Purchasing Alliance for the purchase and implementation of a Cloud based learning management system.  No work may commence and no payment shall be made to vendor prior to the execution of a written agreement. 

 

II. Award Information

Majority Interests:                     No single shareholder owns more than 7.5% of the outstanding shares.

 

Contract Period:                       May 1, 2009 through April 30, 2013 with three (3) additional one (1) year extension options or any combination.  The contract was extended through April 30, 2016.   

 

Contract Amount:                       One-time $239,967.00 for installation and training, and $59,976.00 for an annual license which will be funded from subsequent years’ operating funds.

 

Scope of Services:                      The purchase of a cloud based learning management system to manage all aspects of CPD staff education and training including administration, management, tracking and delivery.

 

 

Affirmative Action

Goals:                       Minority and women owned business enterprise participation for this contract has been waived.

 

Authorization:                      Authorize the General Counsel to include other relevant terms and conditions in the written Agreement.  Authorize the General Superintendent to execute the Agreement and the Secretary to attest as to the signing of the Agreement and keep an original copy of the Agreement on file.

IV.  Procurement Information

 

Chapter XI, Section D, 7 of the Code of the Chicago Park District permits the participation in the contract of another governmental entity or “…a group or consortium of the same,” when it is in the best interest of the Chicago Park District.  Furthermore, the Code adds in Chapter XI, Section D, 7, (a), (i) that the contract with which the CPD desires to participate in must be the result of a public procurement process.

 

U.S. Communities Government Purchasing Alliance (“U.S. Communities”) was created in 1996 as a partnership between the National Association of Counties, National Institute of Governmental Purchasing, the National League of Cities, and the United States Conference of Mayors.  The purpose of US Communities is to aid public agencies nationwide in reducing the cost of goods and services by leveraging the purchasing power of its over 50,000 nationwide public agency members (“members”) including the Chicago Park District.  Its advisory board includes the Chief Procurement Officer for the City of Chicago and other procurement officials from around the country including from the Cities of Denver, Houston, Los Angeles, and Seattle.  Lastly, the National Recreation and Parks Association is a sponsor of US Communities.

 

 

All U.S. Communities contracts are publicly advertised by one of its members, and in 2008 the County of Fairfax, Virginia was the lead agency that advertised the US Communities contract for Technology Products, Equipment and Technology Services and Solutions.  The Request for Proposals was advertised for one month, proposals were received, and Insight is the awardee.

 

V. Explanation

 

The Chicago Park District would like to purchase an online learning system to manage all aspects of staff education and training including administration, management, tracking and delivery. This electronic system will include compliance monitoring, performance management, and online training content. It will allow managers to push training to staff and give staff the ability to access online content from their computer. 

 

Through cooperative purchasing, the CPD regularly participates in contracts with public agencies and entities whose economies are larger, including the City of Chicago.  This gives the CPD the ability to gain economy of scale pricing while expediting the purchase process.  U.S. Communities is a nationwide government purchasing alliance whose purpose is to aid public agencies nationwide in reducing the cost of goods and services by leveraging the purchasing power of its over 50,000 nationwide public agency members, including the CPD.  The CPD would gain this benefit with participation in the Insight Public Sector contract with U.S. Communities.

 

Therefore, the Chicago Park District would like to take advantage of U.S. Communities larger buying power and economy of scale by participating in the Insight Public Sector contract for learning management systems with U.S. Communities.

 

VI. General Conditions

 

1) Conflicts: The Agreement shall not be legally binding on the Chicago Park District if entered into in violation of the provisions of 50 ILCS 105, the Public Officer Prohibited Activities Act.

 

2) Ethics: The Chicago Park District’s Ethics Code, Chapter III of the Code of the Chicago Park District, shall be incorporated into and made part of the agreement.

 

3) Contingent Liability:  Any agreement lawfully entered into for a period of more than one year shall be executory only for the amounts for which the Park District may become liable in succeeding fiscal years pursuant to 70 ILCS 1505/17(i).  The agreement shall contain a clause that any expenditure beyond the current fiscal year is subject to appropriation in the subsequent fiscal year budget.

 

4) Economic Disclosure Statement (“EDS”): Contractor may be subject to a full and complete EDS prior to execution of the contract.
