I. Recommendation
It is recommended that a change order be approved affecting the contract for the subject work; said change to authorize:
Change Order #01: Material and labor escalation costs as well as construction scope of work changes associated with changes to the water main service connection, changes to the sanitary service, additional tree planting, temporary fencing and costs for a donor recognition plaque.

This change order includes work by MBE contractor CPMH for $252,017.73. The Contractor will maintain the minimum 25.00% MBE and 5.00% WBE compliance on this contract.
Change Order #01: Material and labor escalation costs as well as construction scope of work changes associated with changes to the water main service connection, changes to the sanitary service, additional tree planting and costs for a donor recognition plaque.
Material and labor escalation costs were experienced on the project due to a nearly three year work stoppage. Construction proposals were received on June 13, 2018 and construction initially began in July 2018. In September 2018, work was stopped until April 15, 2021. During that time, the construction industry saw significant material cost escalation as well as labor rate increases.
Changes associated with the water main service connection and changes to the sanitary sewer service were a result of City of Chicago permit review comments.
Costs for additional tree planting to replace trees that were removed during the course of construction that were not originally contemplated in the base contract. Additional temporary fencing was utilized to open the track and field for use this past fall. Costs for a donor recognition plaque are also included in this change.
The circumstances that necessitate this change order were not reasonably foreseeable at the time the contract was signed, were not within the contemplation of the contract as signed and are in the best interest of the Chicago Park District.
The contractor’s proposals were thoroughly reviewed by the Project Manager and Engineer of Record and found to be reasonable.

IV. Explanation:
The Chicago Park District has constructed a new 400 meter running track with an artificial turf combination soccer and football field within the track. The track is a regulation IHSA eight lane rubber surface track including a long jump pit and high jump area. The artificial turf field is striped for soccer, football and lacrosse and allows for evening play with newly installed sports lighting. Additional improvements include storm water storage, concrete pad for spectator seating, and a new drinking fountain and landscape throughout.
These improvements are proposed in the South Lakefront Framework Plan 2017-2018 update and are necessary to mitigation against improvements necessitated by the establishment of the Obama Presidential Center within another area of Jackson Park.
VI. General Conditions
1) Conflicts: The Agreement shall not be legally binding on the Chicago Park District if entered into in violation of the provisions of 50 ILCS 105, the Public Officer Prohibited Activities Act.
2) Ethics: The Chicago Park District’s Ethics Code, Chapter III of the Code of the Chicago Park District, shall be incorporated into and made part of the agreement.
3) Contingent Liability: Any agreement lawfully entered into for a period of more than one year shall be executory only for the amounts for which the Park District may become
liable in succeeding fiscal years pursuant to Section 17(i) of the Chicago Park District Act, 70 ILCS 1505/17(i). All agreements authorized herein shall contain a clause that any expenditure beyond the current fiscal year is subject to appropriation in the subsequent fiscal year budget.
4) Economic Disclosure Statement (“EDS”): Contractor has submitted a full and complete EDS.
