I. Recommendation
It is recommended that a change order be approved affecting the contract for the subject work, said change to authorize:
Change Order #01: Additional expenses due to unanticipated design changes required by the Metropolitan Water & Reclamation District (MWRD). This change order also includes a construction time extension because the contractor was unable to proceed with work upon contract award until an MWRD permit was obtained.

This change order includes MBE participation by Burling Builders Inc. for $89,304.00 and by CPMH Construction for $96,718.00 and also includes WBE participation by Chicago Area Plumbing for $61,130.00. Overall project participation including this Change Order is at 33.74% MBE and 7.09% WBE. The Contractor will continue to meet or exceed the minimum 25% MBE and 5% WBE compliance on this contract.
Change Order #01:
Ronan Park runs along the North Branch of the Chicago River and is owned by MWRD. The park contains MWRD buried equipment they own, operate and maintain that includes deep tunnel stormwater infrastructure, associated drop chambers and shafts, a gate structure and access vaults. The Chicago Park District, in addition to obtaining a City of Chicago Dept of Building construction permit, was also required to obtain an MWRD permit before construction could begin.
MWRD’s permit review continued over several months and resulted in required revisions to allow their maintenance vehicles access to their infrastructure within the park. MWRD requires use of a crane with outriggers to maintain their gate structure at the south east corner of the plaza development. Based on the size of that equipment and ability to maneuver around our new built development, larger access pathways were required. Also, access to the northern portion of the development within existing lawn area was needed. Rather than install more hardscape, the permitted design will install a load bearing geogrid installed below the turf grass. The turf grass conceals the geogrid and blends in with the existing landscape. These changes added new costs for the additional excavation, subsurface stone material, increased area of paving and all associated labor costs.
The circumstances that necessitate this contract modification were not reasonably foreseeable at the time the contract was signed, were not within the contemplation of the contract assigned and are in the best interest of the Chicago Park District. The contractor’s proposal has been reviewed by the Project Manager and Design Consultant and found to be reasonable.

IV. Explanation:
Ronan Park is a 12-acre park located in the Albany Park and Lincoln Square Community Areas. The development of a new neighborhood gateway and riverfront plaza at Ronan Park was a result of a vision plan, entitled Confluence: Our Great Rivers in Albany Park which outlined a series of improvements for a new east gateway to Lawrence Avenue. The new park improvements will provide a gathering space for residents and visitors while also creating a place of inspiration. The Ronan Park Gateway and River Plaza Development integrates with the adjacent riverfront of the North Branch of the Chicago River and the community gardens immediately to the west. The improvements include a pavilion shade structure, river overlook structure, pedestrian plaza, and new accessible pedestrian entrances to the park. Site improvements will also include new landscape planting, fencing, site furnishings, and utilities.
