I. Recommendation
Pursuant to Chapter XI, Section C.3.a of the Code of the Chicago Park District, the Director of Purchasing and the Director of Cultural and Natural Resources recommend that the Board of Commissioners of the Chicago Park District (“Board”) enter an order authorizing the General Superintendent or their designee to exercise the first one (1) year extension option on the contract with Flood Brothers Disposal Co. for waste collection, disposal, and recycling services district-wide, Specification No. P-24005.

Contract Period: The initial contract period is from April 17, 2025 to April 17, 2026. If the contract period is extended, the first extension option will run from April 17, 2026 to April 17, 2027. Three options to extend for additional one-year terms will be remaining. If the first extension option is exercised, funding shall be subject to annual appropriations.
Contract Amount: Not to exceed $3,828,000 for the initial one-year term; not to exceed $3,828,000 for the first one-year extension. DUR (depends upon requirements) contract. Expenditures for services remain subject to annual appropriations and each year’s budget.
Scope of Services: Collect waste and recycling at all Chicago Park District parks District-wide except along the lakefront and transport waste and recycling to properly licensed disposal sites and composting facilities.
Authorization: Authorize the General Counsel to include other relevant terms and conditions in the Extension Agreement. Authorize the General Superintendent or their designee to execute the Extension Agreement and the Secretary to attest as to the signing of the Extension Agreement and keep an original copy of the Extension Agreement on file.
II. Performance to Date:
Flood Brothers Disposal Co. (“Flood Brothers”) has provided high quality collection of refuse, recyclable materials, and compostable landscape waste in a professional manner that meets the needs of Chicago Park District (the “Park District”). Flood Brothers has been responsive to Park District requests in a timely manner.

V. Explanation of Recommendation
The Director of Purchasing and the Director of Cultural and Natural Resources request approval by the Board to authorize the first of four (4) one (1)-year extension options to the contract with Flood Brothers for a new contract end date of April 17, 2027.
The Department of Cultural and Natural Resources requires the services of a company that will: (i) collect all waste that is deposited in and around Park District cans, carts, compactors, containers, and dumpsters at the locations throughout the Park District except the lakefront; and (ii) transport all waste to properly licensed disposal sites and composting facilities. Translating the narrative summary of the scope of services into numbers, it is estimated Flood Brothers collects and disposes of 7,000 tons of waste, 1,000 tons of recyclable materials, and 1,800 cubic yards of organic herbaceous waste annually. Further, there are approximately 5,000 containers and dumpsters that Flood Brothers picks up 4-7 times per week during the peak season, May - September, and 1-3 times per week during the off season, October - April. Lastly, in addition to the collection and disposal of waste and recyclable materials, Flood Brothers provides over 950 dumpsters of different sizes throughout the Park District.
Flood Brothers has the experience, capacity, and ability to continue to provide all of the services required in this contract at a fair price. Flood Brothers has been providing its services for over 40 years to municipalities and businesses throughout the Chicago Metropolitan Area. Additionally, Flood Brothers has a large fleet of diverse trucks, equipped with GPS, to serve the Park District. Flood Brothers has shown that it can provide all the dumpsters required and is able to use up to six disposal and composting facilities during the contract term. Finally, Flood Brothers has been responsive in working with the Park District to solve problems when they arise and improve service.
Therefore, it is in the best interest of the Park District to exercise the first one-year extension option of the contract with Flood Brothers Disposal Company for Waste Collection, Disposal, and Recycling Services, Specification No. P-24005.
VI. General Conditions:
1. Conflicts: No agreement authorized herein shall be legally binding on the Chicago Park District if
entered into in violation of the provisions of the Public Officer Prohibited Activities Act, 50 ILCS
105/0.01 et seq.
2. Ethics: Unless already provided for in the original contract, the Extension Agreement shall contain a provision requiring compliance with Chapter III of the Code of the Chicago Park District (“Governmental Ethics”).
3. Contingent Liability: Any agreement lawfully entered into for a period of more than one year
shall be executory only for the amounts for which the Park District may become liable in succeeding fiscal years pursuant to 70 ILCS 1505/17(i). Unless already provided for in the original contract, the Extension Agreement shall contain a clause that any expenditure beyond the current fiscal year is subject to appropriation in the subsequent fiscal year budget.
4. Economic Disclosure Statement (“EDS”): Contractor has submitted a full and complete EDS prior to submission to the Board of Commissioners.
