I. Recommendation
It is recommended that a change order be approved affecting the contract for the subject work said to authorize:
Change Order No. 1: Additional remediation oversight services and supplies as required to complete Phase 1 remediation work at DuSable Park.

Change Order #1: The scope of work for this change order includes services and supplies for additional thorium screening, remediation oversight, verification sampling, and disposal as needed to complete the Phase 1 Remediation of the DuSable Park site.
This change order includes participation by the MBE sub-consultant GSG Consulting in the amount of $93,755.00 and WBE sub-consultant Environmental Design International, Inc. in the amount of $15,320.00.
These additional services and supplies were not foreseeable at the time of the original contract. A significantly larger quantity of thorium was identified during remediation. It was estimated that 200 cubic yards of thorium contaminated fill would require remediation; however, approximately 900 cubic yards of thorium contamination were encountered. This increased quantity of material required additional remedial oversight time, verification sampling and storage and disposal supplies. Additional logistics planning and disposal coordination was also needed. The larger quantity of contaminated material made it economically feasible to used rail car versus trucking which is providing a saving of approximately $150,000 in transportation costs.
The contractor’s proposal has been reviewed by the Project Manager and found to be reasonable.
All work is being completed in accordance to the USEPA approved work plan and all costs are reimbursable through Cooperative Agreement V-00EO2094-0 between the USEPA and the Chicago Park District.
Authorization: Authorize the General Counsel to include other relevant terms and conditions in the written Agreement. Authorize the General Superintendent to execute the Agreement and the Secretary to attest as to the signing of the Agreement and keep an original copy of the Agreement on file.

Note: All expenses for this project are reimbursable through Cooperative Agreement #V-00EO2094-0 with the United States Environmental Protection Agency (“USEPA”).
IV. Explanation
This project is for Phase I of the required thorium screening and remediation at DuSable Park.
Due to the age of the existing seawall, a new seawall will be needed in order to screen the fill
material around the perimeter of the site and immediately adjacent to the seawall. This seawall
replacement and site exterior screening and remediation will be part of Phase II. Phase II
includes the screening and remediation of all material within a 40 foot setback of the existing
seawall. At the conclusion of both Phases of environmental remediation, the park can be developed.
V. General Conditions
1) Conflicts: The Agreement shall not be legally binding on the Chicago Park District if entered into in violation of the provisions of 50 ILCS 105, the Public Officer Prohibited Activities Act.
2) Ethics: The Chicago Park District’s Ethics Code, Chapter III of the Code of the Chicago Park District, shall be incorporated into and made part of the agreement.
3) Contingent Liability: Any agreement lawfully entered into for a period of more than one year shall be executory only for the amounts for which the Park District may become liable in succeeding fiscal years pursuant to Section 17(i) of the Chicago Park District Act, 70 ILCS 1505/17(i). All agreements authorized herein shall contain a clause that any expenditure beyond the current fiscal year is subject to appropriation in the subsequent fiscal year budget.
4) Economic Disclosure Statement (“EDS”): The contractor has submitted a full and complete EDS.
