I. Recommendation
It is recommended that the General Superintendent and CEO or her designee enter into a contract with TERRA Engineering, Ltd., for the purpose of providing design and construction administration services throughout the Chicago Park District. The contractor was selected pursuant to a Request for Proposals (“RFP”). No work may commence and no payment shall be made to vendor prior to the execution of a written agreement.

The Request for Services (RFS) was issued to TERRA Engineers, Ltd. Via the Pre-Qualified Design and Professional Services Pool for Civil and Structural Engineering. The Board approval process requires that whenever a project award exceeds $400,000.00 the Board must first approve the award before the notice-to-proceed may be issued.
V. Explanation
The Chicago Park District seeks the services of a consultant to prepare design and bid documents for the development of a new neighborhood gateway and river plaza at Ronan Park, based on a vision for the site prepared in partnership with the Metropolitan Planning Council and the North River Commission. The vision plan, entitled Confluence: Our Great Rivers in Albany Park outlines, “a series of improvements for a new east gateway to Lawrence Avenue.” The project scope will include improvements to the south end of Ronan Park between Ainslie and Lawrence Avenues and improvements to the community garden site, located immediately west of Ronan Park that is occupied by both the Peterson Garden Project and Global Gardens.
VI. General Conditions
1) Conflicts: The Agreement shall not be legally binding on the Chicago Park District if entered into in violation of the provisions of 50 ILCS 105, the Public Officer Prohibited Activities Act.
2) Ethics: The Chicago Park District’s Ethics Code, Chapter III of the Code of the Chicago Park District, shall be incorporated into and made part of the agreement.
3) Contingent Liability: Any agreement lawfully entered into for a period of more than one year shall be executory only for the amounts for which the Park District may become
liable in succeeding fiscal years pursuant to Section 17(i) of the Chicago Park District Act, 70 ILCS 1505/17(i). All agreements authorized herein shall contain a clause that any expenditure beyond the current fiscal year is subject to appropriation in the subsequent fiscal year budget.
