I. Recommendation
It is recommended that a change order be entered authorizing the General Superintendent or designee to enter into an agreement with DuSable Park Design Alliance for additional design services for the development of DuSable Park for the subject services described below:
Change Order #01: Additional professional design services are required to provide contract documents, bidding, and permitting for the development of DuSable Park.

Change Order #1: The original contract amount included design and community engagement services to deliver 50% design documents for the new DuSable Park development. Following the thorough community engagement process, additional professional design services now are required to provide 100% contract documents, bidding, and permitting for the development of DuSable Park.
Through a competitive bidding process, a design professional has already been awarded for the design of this project. Therefore, a new competitive bidding process for the continuation of design work within the existing project would be neither practical nor advantageous to the Park District for this change order.
It is recommended that a contract be awarded for change order expenses associated with the park design in the amount of $758,444.00. The Design Consultant will maintain the minimum MBE and WBE compliance on this contract.

This contract was publicly advertised as a Target Market Request for Proposals (“RFP”). The
Proposer was selected pursuant to a target market search and received Board of Commissioners approval on March 9, 2022. The contract execution date was September 1, 2022. The contract will be extended to expire on September 1, 2027.
V. Explanation:
DuSable Park is a 3.44-acre park located east of Lake Shore Drive at the confluence of the Chicago River and Lake Michigan. The Chicago Park District retained the services of a consultant team to prepare 50% design documents for DuSable Park based on the recommendations of the 2006 DuSable Park Framework Plan.
Current design was developed and refined through a series of community engagement meetings. The input and feedback that was collected informed into the design concept. DuSable Park will function as the gateway to the Chicago Riverwalk. The site will be accessible via a bus layby lane joining North Water Street with DuSable Lake Shore Drive and a pedestrian bridge connection to the adjacent Lakefront Trail Flyover. Two plazas will serve as gathering spaces for programming and events, while a small woodland on the northern edge will create a quieter, more contemplative space. Parkgoers will be able to access the water’s edge via an ADA accessible boardwalk, spanning the perimeter of the site. Soil will be used to create two scenic hills, affording visitors unique views of the lake, river, and skyline while facilitating the connection to the Lakefront Trail. A wet prairie area, trees, shrubs, grasses, and forbs will provide habitat for bird and pollinator species. Cultural interpretation elements will be used to honor DuSable, Kitihawa, the Potawatomi people, Harold Washington, and park advocates. These elements include a statue, mural wall, historical timeline path, and educational signage.
Continuation of services is necessary in order to advance the design and development of DuSable Park to construction documents. The change order request includes the extension of the design contract to September 1, 2027 to coincide with the construction of the park. DuSable Park is positioned as both a critical piece of Chicago's public lakefront and the gateway to Chicago's Riverwalk.
VI. General Conditions
1) Conflicts: The Agreement shall not be legally binding on the Chicago Park District if entered into in violation of the provisions of 50 ILCS 105, the Public Officer Prohibited Activities Act.
2) Ethics: The agreement shall contain a provision requiring compliance with Chapter III of the Code of the Chicago Park District ("Governmental Ethics").
3) Contingent Liability: Any agreement lawfully entered into for a period of more than one year shall be executory only for the amounts for which the Park District may become liable in succeeding fiscal years pursuant to 70 ILCS 1505/17(i). The agreement shall contain a clause that any expenditure beyond the current fiscal year is subject to appropriation in the subsequent fiscal year budget.
4) Economic Disclosure Statement (“EDS”): Contractor may be subject to a full and complete EDS prior to execution of the contract.
