AUTHORIZATION TO PARTICIPATE IN THE JOINT US COMMUNITIES CONTRACT #USC-001 WITH HERC RENTALS, FOR THE SUPPLY AND DELIVERY OF RENTAL OF SMALL AND LARGE EQUIPMENT

I. Recommendation

 

Pursuant to the Joint Purchasing Agreement between the Chicago Park District (“CPD”) and the U.S. Communities Government Purchasing Alliance (“USC”), it is recommended that the General Superintendent and CEO or their designee enter into a contract with Hertz Equipment Rental Corporation (“Herc”) for the supply and delivery of rental of small and large equipment for District Wide Use from USC Contract, #USC-001, in the amount not to exceed $2,500,000.

 

 

II. Contractor Information

                     25% MBE participation and 5% WBE participation.

 

Scope of Services:                     Supply and Delivery of Rental of Small and Large Equipment for District wide use.

                                                               

Authorization:                      Authorize the General Counsel to include other relevant terms and conditions in the written Agreement.  Authorize the General Superintendent to execute the Agreement and the Secretary to attest as to the signing of the Agreement and keep an original copy of the Agreement on file.

IV. Procurement Information

 

The USC lead agency, North Carolina State University, publicly advertised the Request for Proposal (RFP) for the supply and delivery of Equipment Rental Bids on October 15, 2013 and bids were submitted on the due date of November 14, 2013.  The RFP, at the time of advertisement, in Section 3.6, “Participation by Other USC Government Agencies”, with CPD as a member of USC government agencies that is eligible to participate in the agreement during the contract term and extensions. 

 

V. Explanation

 

The Department of Cultural and Natural Resources and the Department of Facility Management require a company to supply and deliver the rental of small and large vehicles and equipment for personnel to conduct maintenance and capital projects in parks districtwide. This equipment is essential to operations and includes equipment such as aerial trucks used by electricians and forestry staff, specialty dump trucks for water remediation projects and forklifts for material handling as well as other vehicles and equipment.

 

Therefore, the Chicago Park District would like to take advantage of the national government purchasing cooperative larger buying power and economies of scale by entering into this agreement as a joint purchaser with the “USC”, with Herc Rentals.

 

 

VI. General Conditions

 

1) Conflicts: No agreement authorized herein shall be legally binding on the Chicago Park District if entered into in violation of the provisions of the Public Officer Prohibited Activities Act, 50 ILCS 105/0.01 et seq.

 

2) Ethics: The Chicago Park District’s Ethics Code, Chapter III of the Code of the Chicago Park District, shall be incorporated into and made part of all agreements authorized herein.

 

3) Contingent Liability:  Any agreement lawfully entered into for a period of more than one year shall be executory only for the amounts for which the Park District may become liable in succeeding fiscal years pursuant to Section 17(i) of the Chicago Park District Act, 70 ILCS 1505/17(i).  All agreements authorized herein shall contain a clause that any expenditure beyond the current fiscal year is subject to appropriation in the subsequent fiscal year budget.

 

4) Economic Disclosure Statement (“EDS”): Contractor has submitted a full and complete EDS prior to execution of the contract.
