This change order includes work by MBE contractor Natural Creations. The Contractor will maintain the minimum 26.00% MBE and 6.00% WBE compliance on this contract.
Change Order #02: Construction scope of work changes due to permit-required modifications to the traffic signal plans and extended general conditions.
As a part of the Planned Development for Park 596, a new traffic signal at the intersection of S. Western Avenue and W. 48th Place was required. Western Avenue is under the jurisdiction of the Illinois Department of Transportation (IDOT) but is maintained by the City of Chicago, which required IDOT’s concurrence on the traffic study and the geometric approval for the intersection design.
Throughout the permit review process changes to the intersection design were made including: adjustments to the roadway width, curb radius and turning lane dimensions, pedestrian refuge islands, utility crossings and requirements for signal interconnection. These modifications have resulted in scope changes that were not originally contemplated in the contract documents.
Due to the extended permit review process, this work can no longer be completed within the initial construction timeline and requires remobilization of the contractor team, resulting in additional costs for extended general conditions. The general conditions costs include labor costs for the project management team including a project manager, superintendent and project engineer. The general conditions costs also include equipment, dumpsters, fencing, signage and other temporary facilities necessary to execute the work.
This change order also includes reconciliation of the actual costs incurred to date for Change Order #1. Change Order #1 was approved on a Not to Exceed basis due to the unforeseen conditions being encountered in the field during construction to which the full magnitude was not known at the time of the Change Order request.
The circumstances that necessitate this change order were not reasonably foreseeable at the time the contract was signed, were not within the contemplation of the contract as signed and are in the best interest of the Chicago Park District.
The contractor’s proposals will be thoroughly reviewed by the Project Manager and Architect of Record and approved once found to be reasonable.

IV. Explanation:
The Chicago Park District has developed a new 17-acre park and relocated its administrative headquarters to Brighton Park at 48th and Western (Park 596). The Project represents a transformative investment in the Brighton Park Community Area. The Park District’s vision was to bring the community a new fieldhouse for recreation, a new headquarters with employees that contribute to the surrounding local economy and new recreational open space including playing fields, playground and passive space that provide neighborhood residents enjoyment and access to healthy activities for generations to come.
The Project includes a 58,100 square foot, two-story administration headquarters and a 20,000 square foot public field house with a gymnasium, fitness center, bathrooms, locker rooms, community multi-purpose rooms, staff offices and lobby. The Project also includes outdoor park improvements including two artificial turf athletic fields with lighting, a grand lawn, walkways, parking, playground and nature play area, spray pool, and natural area.
VI. General Conditions
1) Conflicts: The Agreement shall not be legally binding on the Chicago Park District if entered into in violation of the provisions of 50 ILCS 105, the Public Officer Prohibited Activities Act.
2) Ethics: The agreement shall contain a provision requiring compliance with Chapter III of the Code of the Chicago Park District (“Governmental Ethics”).
3) Contingent Liability: Any agreement lawfully entered into for a period of more than one year shall be executory only for the amounts for which the Park District may become liable in succeeding fiscal years pursuant to Section 17(i) of the Chicago Park District Act, 70 ILCS 1505/17(i). All agreements authorized herein shall contain a clause that any expenditure beyond the current fiscal year is subject to appropriation in the subsequent fiscal year budget.
4) Economic Disclosure Statement (“EDS”): Contractor has submitted a full and complete EDS.
