Change Order #1:      
 
A change order at Northerly Island is needed to address flooding issues created by waves overtopping from Lake Michigan. Excavation has also unearthed the original timber crib revetment from the time of the 1933 World's Fair. The additional funding will be used to increase the height of the lakefront revetment, build cobble shoots to direct wave action into the newly created pond, and to build overlooks adjacent to the timber crib revetment.
 
Authorization:      Authorize the General Counsel to include other relevant terms and conditions in the written Agreement.  Authorize the General Superintendent to execute the Agreement and the Secretary to attest as to the signing of the Agreement and keep an original copy of the Agreement on file.

IV. Explanation
 
Section X of the General Conditions of the contract permit changes to the scope of work.  Additionally, Chapter XI, Section #, 4, of the Code of the Chicago Park District permits change orders under one or more of the following circumstances:  (i) the circumstances that necessitate the change were not reasonably foreseeable at the time that the contract was signed; or (ii) the change is germane to the original contract as signed; or (iii) the change order is in the best interest of the project and the Chicago Park District as authorized by law.
 
 
 
 
 
 
 
 
 
 
The changes identified in this change order were not foreseeable when the project started construction.  Lake Michigan waves have been overtopping the existing retaining wall along the east side of Northerly Island causing severe erosion.  The lake levels are 1.5 feet higher than last year increasing the wave heights.  The Army Corps will be placing stone blocks to dissipate wave action before it enters the park.  If any waves overtop the revetment, stone cobbles will direct the water into the newly formed pond.  Soil borings in the planning phase of the project did not indicate the presence of underground wooden revetment structures.  During construction
the old wooden crib revetment which was the border of the park during the 1933 World's Fair was unearthed.  The crib will be left in place with sections removed to allow for water circulation.  Overlooks will be placed at the north and south ends of the pond allowing for viewing the wooden crib and panoramic views of the park.  The Army Corps portion of the funding is $6,222,170 and the Park District's portion is $3,246,820 for a total project amount of $9,468,990.
 
 
VI. General Conditions
1. Conflicts:  No agreement authorized herein shall be legally binding on the Chicago Park District if entered into in violation of the provisions of the Public Officer Prohibited Activities Act, 50 ILCS 105/0.01 et seq.
 
2. Ethics: The Chicago Park District's Ethics Code, Chapter III of the Code of the Chicago Park District, shall be incorporated into and made part of all agreements authorized herein.
 
3. Contingent Liability:  Any agreement lawfully entered into for a period of more than one year shall be executory only for the amounts for which the Park District may become liable in succeeding fiscal years pursuant to Section 17(i) of the Chicago Park District Act, 70 ILCS 1505/17(i).  All agreements authorized herein shall contain a clause that any expenditure beyond the current fiscal year is subject to appropriation in the subsequent fiscal year budget.
 
4.  Economic Disclosure Statement ("EDS"): Contractor has submitted a full and complete EDS prior to execution of the contract.
