It is recommended that an order be entered authorizing the General Superintendent or their designee to enter into a contract with JL Corp. d/b/a Harry’s Lumber Corp. for the supply and delivery of Lumber and Building Materials and Supplies-Districtwide.  This contractor was selected pursuant to a publicly advertised Invitation for Bid.  No work may commence and no payment shall be made prior to the execution of a written agreement.

Contract Period:                       One (1) year initial term with four (4) additional one (1) year extension options.  If the extension options are exercised, funding shall be based upon annual appropriations.

                     This is a DUR (Depends Upon Requirements) Contract, where the actual annual spending for the initial contract term and any extension term is determined based on the District’s identified needs and which is authorized by annual appropriation and subject to each year’s budget. Material costs may increase in extension terms if justified and recommended by the Director of Purchasing.

 

Affirmative Action                      

Goals:                       The Minority and Women Owned Business Enterprise participation for this contract has been waived for this specification. Good faith efforts for both MBE and WBE participation have been executed by Harry’s Lumber.  A letter was provided, by Harry’s Lumber, that demonstrated the use of both non-certified minority and women owned companies in the daily course of their business.  Harry’s Lumber will work over the next four months to have the companies presented become certified companies and/or use as applicable those companies currently certified in the various City, County and affinity organizations databases that are recognized certified minority and women owned companies.

 

Scope of Services:                       For the supply and delivery of Lumber and Building Materials and Supplies-Districtwide, on an as-needed basis.

 

Authorization:                     Authorize the General Counsel to include other relevant terms and conditions in the written Agreement. Authorize the General Superintendent or their designee to execute the Agreement and the Secretary to attest as to the signing of the Agreement and keep an original copy of the Agreement on file.

This contract was publicly advertised as an Invitation for Bids (“IFB”) and there were three (3) sections with a total of 21 categories for bid; bidders could bid on one, some, or all categories.  Two (2) bids were submitted and received on the due date and time. The Department of Purchasing (“Purchasing”) reviewed all bid packages received and found one (1) bidder to be compliant and responsive in two sections including a total of 13 categories. The Department of Facility Management reviewed the bid of the apparent lowest responsive bidder for each section and category and found the  prices they submitted to be fair and reasonable. Accordingly, it has been determined that JL Corp. d/b/a Harry’s Lumber Corp. as the lowest responsible and responsive bidder in the following categories:

V. Explanation

 

The Department of Facility Management is responsible for repairing and maintaining Chicago Park District facilities districtwide and requires the services of companies that supply lumber and building materials and supplies to perform this responsibility, on an as needed basis year-round.  Having these contracts in place allows the Department of Facility Management to meet operational needs at a fair and reasonable price while maintaining facilities that often have heavy use and require constant upkeep and maintenance. The awardee has submitted the lowest responsive and responsible bid for the applicable contract categories Section 1 and 2. JL Corp. d/b/a/ Harry’s Lumber Corp also has the experience and capability to perform the services required in this contract. 

 

The awardee did not submit a bid to provide materials for Section 3, and the second bid was deemed not responsive or compliant. Section 3 will not be awarded under this authority.

 

Therefore, it is in the best interest of the Chicago Park District to award JL Corp. d/b/a/ Harry’s Lumber Corp. the contract for Sections 1 and 2, for the applicable categories, for the supply and delivery of Lumber and Building Materials and Supplies- districtwide.

 

 

VI. General Conditions

 

1) Conflicts: The Agreement shall not be legally binding on the Chicago Park District if entered into in violation of the provisions of 50 ILCS 105, the Public Officer Prohibited Activities Act.

 

2) Ethics: The agreement shall contain a provision requiring compliance with Chapter III of the Code of the Chicago Park District ("Governmental Ethics"). 

 

3) Contingent Liability:  Any agreement lawfully entered into for a period of more than one year shall be executory only for the amounts for which the Park District may become liable in succeeding fiscal years pursuant to 70 ILCS 1505/17(i).

 

4) Economic Disclosure Statement (“EDS”). Contractor has submitted full and complete EDS.
