II. Award Information (Cont.)
Change Order No. 02:
This Change Order includes extensive repair and replacement of deteriorated infrastructure discovered during demolition that wouldn’t have been known at the time the construction documents were created until walls and floors were opened up and excavation started within the adjacent building footprint for utility work.
This change order includes work by MBE contractors Drive Construction, M. Mendoza, Inc. and Sandsmith Masonry. In total, the MBE portion of this Change Order is $193,552.55 (24.24%).
This change order includes work by WBE contractor JEM Development, Inc. In total, the WBE portion of this Change Order is $50,000.00 (6.26%).
Exterior Stormwater System and Buried Utilities:
Extant drainage systems (14 roof drains and associated buried connections, sewers and catchbasins) were initially investigated and identified for a limited amount of repairs. However, during the initial implementation of repairs virtually all of these components were found to be in such deteriorated condition that extensive additional replacement is mandatory. This additional exterior work will involve labor-intensive hand-digging to protect separate buried utilities and will include landscape and paving restoration necessitated by the excavation.
Interior Plumbing Systems:
Preliminary repairs uncovered interior plumbing deterioration and conditions that require upgrades for code compliance, particularly obsolete or missing vents at plumbing fixtures. This work also necessitates related access openings in walls and subsequent wall finish repairs. Replacement of additional toilets in the Women’s Washroom is owner directed to eliminate mismatched fixtures and buried controls.
Added Requirements for Elevator Shaft:
Two (2) existing Fieldhouse walls that had been anticipated to serve for new elevator shaft walls were discovered to be out of plumb and unsuitable for the elevator shaft, necessitating a shifted shaft location with elimination of additional piping and infrastructure obstructions. Change Order No. 01 addressed 75% of the revisions needed for the elevator shift shaft, and this Change Order No. 02 will address the remaining 25% of work, which primarily involves relocation of existing utilities to be clear of the new elevator shaft location.

Bird Deterrent Systems:
Unlike the other items, this is an owner directed change to combat the serious contamination issues resulting from nesting birds on many building façade locations. Adding this work now with mobilized crew and in conjunction with the other exterior building envelope work is prudent. The proposed systems are superior to widely-available generic systems, are uniquely-sensitive to historic structures, have been successfully employed at hundreds of structures and landmarks throughout the nation, and have proven to be successful at three (3) CPD structures over the last six (6) years (Columbus Park Refectory, Douglass Park Flower Hall, and Humboldt Park Boathouse).
The circumstances that necessitate this contract modification were not reasonably foreseeable at the time the contract was signed, were not within the contemplation of the contract assigned and are in the best interest of the Chicago Park District.
The contractor’s proposal has been reviewed by the Project Manager and Design Consultant and found to be reasonable.

IV. Explanation:
Section X of the General Conditions of the contract permit changes to the scope of work. Additionally, Chapter XI, Section #, 4, of the Code of the Chicago Park District permits change orders under one or more of the following circumstances: (i) the circumstances that necessitate the change were not reasonably foreseeable at the time that the contract was signed; or (ii) the change is germane to the original contract as signed; or (iii) the change order is in the best interest of the project and the Chicago Park District as authorized by law.
The Chicago Park District received Tax Increment Financing Funds that will be invested in the park. Improvements include concrete and masonry (i.e. stairs, elevator, building masonry), windows, roof and gutters, landscaping, lighting, plumbing infrastructure, HVAC, accessibility upgrades and other related interior and exterior repairs.
V. General Conditions
1. Conflicts: No agreement authorized herein shall be legally binding on the Chicago Park District if entered into in violation of the provisions of the Public Officer Prohibited Activities Act, 50 ILCS105/0.01 et seq.
2. Ethics: The Chicago Park District’s Ethics Code, Chapter III of the Code of the Chicago Park
District, shall be incorporated into and made part of all agreements authorized herein.
3. Contingent Liability: Any agreement lawfully entered into for a period of more than one year shall be executory only for the amounts for which the Park District may become liable in succeeding fiscal years pursuant to Section 17(i) of the Chicago Park District Act, 70 ILCS 1505/17(i). All agreements authorized herein shall contain a clause that any expenditure beyond the current fiscal year is subject to appropriation in the subsequent fiscal year budget.
4. Economic Disclosure Statement (“EDS”): Contractor has submitted a full and complete EDS
prior to execution of the contract.
