I. Recommendation
It is recommended that an order be entered authorizing the General Superintendent or their designee to enter into an Agreement with the City of Chicago’s Department of Fleet and Facility Management for Fuel Supply, Equipment Maintenance and Repairs.

Agreement Term: The term of the Agreement shall commence on the date of its execution and shall expire on the same date as the execution of the Agreement in 2028 (the “Term”), unless terminated earlier pursuant to the Agreement. The parties shall have a right to extend the Agreement for two (2) years.
Authorization: Authorize the General Superintendent and/or their designee to negotiate, enter into, and execute such agreement, amendments, and related documents and perform any and all acts as shall be necessary or advisable in connection with the transaction described herein. Authorize the General Counsel to include other relevant terms and conditions in the written agreements, amendments and instruments. Authorize the Secretary to attest as to the signing of the Agreements.

IV. Explanation
This Intergovernmental Agreement (IGA) between the City of Chicago (City) and the Chicago Park District (Park District) is necessary for the purposes of granting Park District vehicles access to City of Chicago fueling sites and allow the City’s Department of Fleet and Facility Management to maintain and repair certain Park District-owned equipment on a regular basis.
The Chicago Park District has had an IGA with the City of Chicago Department of Facility and Fleet Management dating back to 2000. The City performs maintenance services on over 300 pieces of Park District-owned vehicles and equipment. The City also provides fuel for Park District vehicles at 14 fuel sites located throughout the city. In addition to the 300 Park District-owned vehicles and pieces of equipment that receive maintenance services, the Park District has an additional inventory of 500 pieces of leased equipment and 300 pieces of seasonally rented equipment that use the City’s fuel services.
V. General Conditions
1. Conflicts: No agreement authorized herein shall be legally binding on the Chicago Park District if entered into in violation of the provision5s of the Public Officer Prohibited Activities Act, 50 ILCS 105/0.01 et seq.
2. Ethics: The agreement shall contain a provision requiring compliance with Chapter III of the Code of the Chicago Park District ("Governmental Ethics").
3. Contingent Liability: Any agreement lawfully entered into for a period of more than one year shall be executory only for the amounts for which the Park District may become liable in succeeding fiscal years pursuant to Section 17(i) of the Chicago Park District Act, 70 ILCS 1505/17(i).
