I. Recommendation
It is recommended that the General Superintendent and CEO or the designee enter into a contract with Mode Architects for the purpose of providing architectural design services for ADA improvements at 82 Park polling sites The Consultant was selected pursuant to a Request for Services (“RFS”). The total contract award shall not exceed $990,520.00. No work may commence and no payment shall be made to vendor prior to the execution of a written agreement.

The Request for Services (RFS) was issued to Mode Architects via the Pre-Qualified Design and Professional Services Pool for Architecture. The Board approval process requires that whenever a project award exceeds $400,000.00 the Board must first approve the award before the notice-to-proceed can be issued.
V. Explanation
Background: For all Polling places a Settlement Agreement (the "Agreement") was entered April 11, 2017 ("Effective Date"), between the United States of America (DOJ) and the Board of Election Commissioners for the City of Chicago, Illinois (collectively, the "Parties").
The Chicago Park District has 143 Polling places, which required certain level of ADA modifications for Polling places. Out of 143 sites selected by Chicago Board of Elections, Park District hired an Architectural firm (LCM Architects) to conduct in-depth surveys and reports for 111 sites in April 2021. These reports and surveys will be utilized to address the non-compliant elements of the voting places.
A number of park sites are already in construction in current Capital plan or have been addressed via work orders. But the remaining 82 sites that need ADA modifications need design and bid documents. Park District requested a proposal from an architectural firm of Mode Architects via the Pre-Qualified Design & professional services pool to provide a package of design and construction documents. Mode Architects have the expertise and technical experience because of their recent contract with Chicago Public School to provide similar design services for 85 polling sites in 2022-2023.
The scope of work for the Chicago Park District polling sites is to focus on upgrades for the path of travel and areas designated for use as polling places to meet current accessibility Code requirements. This includes regrading existing ADA parking stalls, exterior walkways, constructing new compliant ramps, and providing compliant doors and hardware, compliant interior voting areas as identified in reports /documents provided by the Chicago Park District. The scope of work includes eighty-two (82) sites that contain historic buildings. Where feasible existing historic and non-historic features and equipment are to be retained and modified to meet current requirements. Services include the required site verifications, modifications, design, construction documents and specifications to enable Permitting.
VI. General Conditions
1) Conflicts: The Agreement shall not be legally binding on the Chicago Park District if entered into in violation of the provisions of 50 ILCS 105, the Public Officer Prohibited Activities Act.
2) Ethics: The Chicago Park District’s Ethics Code, Chapter III of the Code of the Chicago Park District, shall be incorporated into and made part of the agreement.
3) Contingent Liability: Any agreement lawfully entered into for a period of more than one year shall be executory only for the amounts for which the Park District may become liable in succeeding fiscal years pursuant to Section 17(i) of the Chicago Park District Act, 70 ILCS 1505/17(i). All agreements authorized herein shall contain a clause that any expenditure beyond the current fiscal year is subject to appropriation in the subsequent fiscal year budget.
