I. Recommendation
Pursuant to Chapter 11, Section D.7 of the Code of the Chicago Park District, the Director of Facility Management and the Director of Purchasing recommend that an order be entered authorizing the General Superintendent and CEO or their designee to join in the City of Chicago’s contract #114541, (SPEC #738719) with EJM Engineering, Inc., dba TranSmart, LLC. for professional engineering services for power distribution desig, in the amount not to exceed $800,000.

This is a DUR (Depends Upon Requirements) Contract, where the actual annual spending for the initial contract term and any extension term is determined based on the District’s identified needs and which is authorized by annual appropriation and subject to each year’s budget.
Scope of Services: Purchase of power distribution design engineering services for utility improvements.
Compliance
Goals: This is a Target Market contract where bidding was restricted to local certified Minority and Woman-Owned Business Enterprises (MBE/WBE), and joint ventures consisting exclusively of MBE’s, WBE’s, or both. The proposal for this authorization includes 100% MBE participation with TranSmart, LLC. as a MBE self-preforming vendor, and 0% WBE participation.
Authorization: Authorize the General Counsel to include other relevant terms and conditions in the written Agreement. Authorize the General Superintendent to execute the Agreement and the Secretary to attest as to the signing of the Agreement and keep an original copy of the Agreement on file.

IV. Procurement Information
Pursuant to Chapter 11, Section D.7 of the Code of the Chicago Park District, when it is in the best interest of the Park District, the Director of Purchasing may use Cooperative Purchasing to join in another governmental entity’s contract with its respective vendor or contractor. Here, the Department of Purchasing submitted this joint participation request to the City’s Chief Procurement Officer and received their approval to proceed under Categories 1, 2, and 4. (See attached letters).
The City publicly advertised the Request for Quotation (RFQ) (viz. IFB) for the Master Task Order Contract for Professional Engineering Services for City-Wide CDOT Projects - Target Market Contract #114541, (SPEC #738719). Bids were submitted to the City in a qualified pool. The RFQ, at the time of advertisement, in Section 3.1.4.12, “Participation by Other Local Government Agencies”, named the CPK as a local government agency that is eligible to participate in the agreement during the contract term and extensions.
V. Explanation
The Department of Facility Management requires a company to supply power distribution design services for major electrical upgrades to aging infrastructure. The Park District supplies electrical services to several parks from Powerhouse Substations located within Garfield, Washington, and Lincoln Parks. The existing electrical system at the Garfield Substation currently provides power to LaFollette, Union, and Skinner Parks. The Washington Park Substation supplies Washington Park and Jackson Park including the harbors, field house, and concessions. The Park District Substation in Lincoln Park provides electric supplies to all of Lincoln Park from Ohio Street to Hollywood Avenue including amenities on both the east and west sides of DuSable Lake Shore Drive. Due to the length of the runs and the age of the infrastructure, the Park District is working on replacing these services with Commonwealth Edison services. Professional engineering services are needed for portions of this work to be completed with Commonwealth Edison.
Therefore, the Chicago Park District would like to take advantage of the City’s larger buying power and economies of scale by entering participation with the City’s contract with TranSmart, LLC for power distribution designs for utility improvement.
VI. General Conditions
1) Conflicts: No agreement authorized herein shall be legally binding on the Chicago Park District if entered into in violation of the provisions of the Public Officer Prohibited Activities Act, 50 ILCS 105/0.01 et seq.
2) Ethics: The agreement shall contain a provision requiring compliance with Chapter III of the Code of the Chicago Park District ("Governmental Ethics").
3) Contingent Liability: Any agreement lawfully entered into for a period of more than one year shall be executory only for the amounts for which the Park District may become liable in succeeding fiscal years pursuant to Section 17(i) of the Chicago Park District Act, 70 ILCS 1505/17(i). All agreements authorized herein shall contain a clause that any expenditure beyond the current fiscal year is subject to appropriation in the subsequent fiscal year budget.
4) Economic Disclosure Statement (“EDS”): Contractor has submitted a full and complete EDS prior to execution of the contract.
