I. Recommendation
Pursuant to Chapter XI, Section C.3.a of the Code of the Chicago Park District, the Director of Purchasing and the Director of Facility Management recommend that the Board of Commissioners of the Chicago Park District (“Board”) authorize the General Superintendent or their designee to exercise the third one-year contract extension options with each of J.P. Simons & Co. and Midco Electric Supply, Inc. for the supply and delivery of electrical supplies, Specification No. P-23004.

Contract Period: One (1) year initial term with four (4) additional one (1) year extension options. The contract execution dates were June 9, 2023 for Midco Electric Supply, Inc. and July 18, 2023 for J.P. Simons & Co. These are the third extension option requests.
Contract Amount: Not to exceed $4,967,757.45 in the aggregate for the initial contract terms (see below for amounts by category). Expenditures for services under each extension term will be authorized by annual appropriation and subject to each year’s budget. These are DUR (depends upon requirements) contracts.
Scope of Services: For the supply and delivery of electrical supplies to the Chicago Park District, on an as-needed basis.
Authorization: Authorize the General Counsel to include other relevant terms and conditions in the extension agreements (the “Extension Agreements”). Authorize the General Superintendent or their designee to execute the Extension Agreements and the Secretary to attest as to the signing of the Extension Agreements and keep original copies of the Extension Agreements on file.

III. Performance to Date
Both J.P. Simons & Co. and Midco Electric Supply, Inc. have met the expectations under these contracts in the initial terms and in the subsequent first- and second-year contract extension options to supply and deliver electrical supplies to the Chicago Park District. Furthermore, both vendors have the capacity to meet the delivery requirements of the Chicago Park District. Both vendors have also maintained good standing as contractors and performed their duties in an efficient and timely manner.

Based on current spend, Midco Electric Supply, Inc. is expected to accomplish the 2% needed compliance by the renewal date of June 9, 2026. The percentages shown are against paid contract spend. The opportunity for direct and indirect M/WBE spend is limited for these commodity purchases.
V. Explanation of Recommendation
The Director of Purchasing and the Director of Facility Management request approval by the Board to authorize the third one-year contract extension options with J.P. Simons & Co. and Midco Electric Supply, Inc.
The Department of Facility Management (DFM) is responsible for repairing and maintaining Chicago Park District facilities districtwide and requires vendors that can provide electrical supplies on an as-needed basis throughout the year. These supplies support both indoor and outdoor electrical maintenance needs and includes items such as outlets, switches, fixtures, breakers, wiring, light poles, and LED lighting products. Having these contracts in place enables the DFM to efficiently meet operational demands at fair and reasonable prices, ensuring the continued upkeep of several hundred heavily used facilities across the Park District.
Therefore, it is in the best interest of the Chicago Park District to grant the third one-year extension options, with the negotiated prices and no change to the contract values, to the awarded contracted vendors of J.P. Simons & Co. and Midco Electric Supply, Inc. for the applicable categories.
VI. General Conditions
1) Conflicts: No agreement authorized herein shall be legally binding on the Chicago Park District if entered into in violation of the provisions of the Public Officer Prohibited Activities Act, 50 ILCS 105 et seq.
2) Ethics: The Extension Agreements shall each contain a provision requiring compliance with Chapter III of the Code of the Chicago Park District (“Governmental Ethics”).
3) Contingent Liability: Any agreement lawfully entered into for a period of more than one year shall be executory only for the amounts for which the Park District may become liable in succeeding fiscal years pursuant to 70 ILCS 1505/17(i).
4) Economic Disclosure Statement (“EDS”): The contractors have submitted full and complete EDSs prior to submission to the Board.
