I. Recommendation
It is recommended that an order be entered authorizing the General Superintendent or her designee to enter into contracts with Palos Sports, Inc. for the supply or delivery of sporting goods. This contractor was selected pursuant to a publicly advertised Invitation for Bids. No work may commence and no payment shall be made to the contractor prior to the execution of a written agreement.

Authorization: Authorize the General Counsel to include other relevant terms and conditions in the written Agreement. Authorize the General Superintendent to execute the Agreement and the Secretary to attest as to the signing of the Agreement and keep an original copy of the Agreement on file.

This contract was advertised as an Invitation for Bids (“IFB”). Three (3) bids were received, opened publicly, and read aloud on the bid due date. Two (2) bids were found by the Department of Purchasing (“Purchasing”) to be non-responsive with the requirements specified in the IFB and removed from consideration. Accordingly, one (1) bid was found by Purchasing to be both responsive and compliant.
There were 19 categories for bid, and bidders could bid on one, some, or all categories. eighteen (18) categories received more than one bid, and 1 received one bid. One (1) category was cancelled because no responsive bids were received. Of the 18 categories that remained, eighteen (18) received more than one bid and. Accordingly, based on the results of the bid review, it has been determined that the lowest responsive and responsible bidders for the categories are:

V. Explanation
Annually, the Chicago Park District requires sporting goods for the sports and recreation programming including Junior Bears. Both Palos Sports have previous experience supplying and delivering sporting goods to the Park District and have the capacity and ability to meet the Park District’s needs. Therefore, it is in the best interest of the Chicago Park District to award Palos Sports, Inc. the contracts for the Supply and Delivery of Sporting Goods.
VI. General Conditions
1) Conflicts: The Agreement shall not be legally binding on the Chicago Park District if entered into in violation of the provisions of 50 ILCS 105, the Public Officer Prohibited Activities Act.
2) Ethics: The Chicago Park District’s Ethics Code, Chapter III of the Code of the Chicago Park District, shall be incorporated into and made part of the agreement.
3) Contingent Liability: Any agreement lawfully entered into for a period of more than one year shall be executory only for the amounts for which the Park District may become
liable in succeeding fiscal years pursuant to Section 17(i) of the Chicago Park District Act, 70 ILCS 1505/17(i). All agreements authorized herein shall contain a clause that any expenditure beyond the current fiscal year is subject to appropriation in the subsequent fiscal year budget.
