I. Recommendation

 

It is recommended that the General Superintendent and CEO or the designee enter into individual agreements with the contractors identified on attached Exhibit A for inclusion into the General Contractor Services pre-qualified pool. The pre-qualified contractors were selected pursuant to a publicly advertised Request for Qualification (RFQ). No minimum amount of work is required or guaranteed to the contractors in the pre-qualified pool. Each contractor must enter into an agreement for inclusion in the pre-qualified pool, and once in the pool, no work may commence and no payment shall be made until contractor is awarded a project and receives a Notice-to-Proceed from the Chicago Park District (CPD).

 

                                                                                    

II. Award Information

 

Contractors:                      Twenty-Three (23) pre-qualified contractors under the category of “New Construction/Renovation” and thirteen (13) pre-qualified contractors under the category of “Playground Construction” as listed on Exhibit A (attached and incorporated by this reference).

Contract Term:                      Five (5) year contract term expiring on December 31, 2028 with one (1) additional one (1) year extension

Scope of Services:                     Generally, projects for this pre-qualified pool may involve both building or park construction and renovation, and some projects may involve both. Specific scope could include roofing, masonry, mechanical, electrical, plumbing, architectural finishes and general carpentry, ADA compliance upgrades, pool systems, windows, doors, hardware, signage, paving, landscaping, utilities, water parks/spray pools, athletic fields, playgrounds, park monuments, sport courts, park structures, fencing.

Authorization:                     Authorize the General Counsel to include other relevant terms and conditions in the written Agreement.  Authorize the General Superintendent to execute the Agreement and the Secretary to attest as to the signing of the Agreement and keep an original copy of the Agreement on file.

Date Proposals Due:                     Advertised initial deadline was February 10, 2023 later extended to April 14, 2023. The RFQ remains publicly advertised on the Chicago Park District website within the Doing Business / Purchasing page under Contracting Opportunities with a Close Date of December 31, 2027. Any contractor may submit its qualification package at any time until this date. The goal is to review any new RFQ packages received on a quarterly basis. Any contractors deemed acceptable will enter into an agreement for inclusion into the Rapid Response pre-qualified pool.

 

Qualification Packages Evaluation

This package was advertised as an RFQ; a total of twenty-eight (28) qualification packages were received. Accordingly, all qualification packages were first reviewed by Department of Purchasing for both responsiveness and compliance. All twenty-eight (28) were found to be both responsive and compliant and issued to the Evaluation Committee members (EC) for review.

 

The EC was comprised of five (5) voting members, all CPD employees. The EC reviewed all qualification packages. Contractors had the opportunity to apply under the category of “New Construction/Renovation” and/or “Playground Construction”.

 

For the New Construction/Renovation category, the EC concluded that twenty-three (23) contractor packages out of the twenty-eight (28) were found to be the most advantageous to the CPD. Of these accepted firms, ten (10) will be new to the pre-qualified pool with the other thirteen (13) contractors having been a member of the current General Contractor Services pool.

 

For the Playground Construction category, the EC concluded that thirteen (13) contractor packages out of twenty-one (21) were found to be the most advantageous to the CPD. Of these accepted firms, six (6) will be new to the pre-qualified pool with the other seven (7) contractors having been a member of the current General Contractor Services pool.

 

 

V.  Explanation

 

The CPD is establishing this pool of pre-qualified contractors as a method of procuring General Contractor Services to be performed throughout all CPD parks and facilities as needed. Contractors accepted into this pre-qualified pool with signed agreements are eligible to receive project-specific Request for Proposal packages for competitive pricing. The RFQ does not guarantee any contractor in the pool future project awards or provides specific project scope but instead describes in general terms the type of services that will be involved in future projects.

 

Accordingly, the RFQ does not include the MBE/WBE Schedules wherein contractor dollar amounts and percentages of their participation for a specific project would be disclosed. The RFQ included a Compliance Affidavit that required contractors’ signature as part of their RFQ response that commits to the goal of achieving 25% Minority Business Enterprise (MBE) participation and 5% Women Business Enterprise (WBE) participation.

 

Additionally, any project award that exceeds the value of $2,500,000 will be presented to the Board of Commissioners for their approval.

 

All of the firms recommended for inclusion into this pre-qualified pool have the experience and ability to provide the services as specified and to meet or exceed the standards of the CPD. Therefore, it is in the best interest of the CPD to award these contractor agreements for inclusion in the General Contractor Services pre-qualified pool.

 

 

VI. General Conditions

 

1) Conflicts: The Agreement shall not be legally binding on the Chicago Park District if entered into in violation of the provisions of 50 ILCS 105, the Public Officer Prohibited Activities Act.

 

2) Ethics: The Chicago Park District’s Ethics Code, Chapter III of the Code of the Chicago Park District, shall be incorporated into and made part of the agreement.

 

3)  Contingent Liability:  Any agreement lawfully entered into for a period of more than one year shall be executory only for the amounts for which the Park District may become liable in succeeding fiscal years pursuant to Section 17(i) of the Chicago Park District Act, 70 ILCS 1505/17(i).  All agreements authorized herein shall contain a clause that any expenditure beyond the current fiscal year is subject to appropriation in the subsequent fiscal year budget.

 

4)  Economic Disclosure Statement (“EDS”):  Contractors have submitted a full and complete EDS.
